Risk assessment is a probabilistic exercise — and probabilistic conclusions about an individual based on group data are exactly where opposing counsel attacks. Different proceedings, different stakes, same methodology bar.
Forensic violence risk assessments are commissioned across a wide range of legal proceedings: civil commitment hearings, capital and non-capital sentencing, parole and probation decisions, fitness-for-duty examinations, threat-assessment consultations, and SVP / sexually violent predator commitment (a closely related but methodologically distinct evaluation type). The legal questions vary; the methodological standard does not. The published forensic literature on risk assessment is large, peer-reviewed, and unforgiving of unstructured clinical judgment as the primary basis of opinion.
Barefoot v. Estelle, 463 U.S. 880 (1983), upheld the admissibility of psychiatric risk testimony in capital sentencing despite an APA amicus brief explicitly arguing that such testimony was unreliable. The case has not been overruled, but the empirical landscape it sits on top of has changed considerably — the actuarial and SPJ literatures now carry the field, and reports that rely solely on unstructured clinical impression have shifted from defensible to indefensible. Kansas v. Hendricks, 521 U.S. 346 (1997), and Kansas v. Crane, 534 U.S. 407 (2002), anchor the SVP framework. Ake v. Oklahoma, 470 U.S. 68 (1985), governs expert appointment in capital cases. And the Tarasoff line, while clinical in origin, has shaped the threshold question of when clinical risk judgments cross into a forensic threat assessment.
Three approaches. Only two of them are defensible.
Unstructured clinical judgment
Pure clinical impression with no structured tool, no actuarial anchor, and no published framework. The forensic literature on this approach is consistent and unflattering: predictive accuracy is at or near chance, and reliability across evaluators is low. Reports that anchor on unstructured judgment in a Daubert jurisdiction are exposed at the threshold.
Actuarial
Formal, mechanical scoring of empirically derived risk factors against a published norming sample. VRAG-R, the Static-99R (for sexual violence), the COVR — each produces a probabilistic estimate keyed to a comparison group. Methodologically the strongest in terms of reliability and predictive validity. The vulnerability is the group-to-individual inference and the base-rate sensitivity of the comparison sample.
Structured Professional Judgment (SPJ)
A structured framework — HCR-20 V3, SVR-20, RSVP, and others — that requires the evaluator to rate empirically derived risk and protective factors and integrate them into a final risk formulation. The SPJ literature is robust and the approach is widely accepted. Strong on individualization. Less precise than actuarial on raw predictive accuracy, but more defensible on the question of why the particular individual is at the indicated risk level.
The integrated approach
Most contemporary forensic violence risk assessments combine actuarial and SPJ tools, with the actuarial providing the probabilistic anchor and the SPJ providing the case-specific formulation. Reports that use both, document the reason for each, and integrate rather than average them are the most defensible pattern in the published literature.
Where violence risk assessments get attacked.
Group-to-individual inference
The single most exploited weakness in risk testimony. Actuarial scores describe the recidivism rate of a comparison group; they do not predict the behavior of the specific individual. Reports that conflate the group probability with an individual prediction (“the defendant will commit” rather than “the defendant’s risk classification has a published recidivism rate of…”) are routinely impeached.
Base-rate insensitivity
Risk classifications are only as meaningful as the base rate of the predicted behavior in the relevant population. Reports that don’t address the base rate — or that report risk in a population with a base rate so low that even a high-classification examinee is more likely than not to never reoffend — expose the evaluator to a Bayesian cross-examination most attorneys are now trained on.
Time-frame ambiguity
“Future violence” over what window? Five years? Lifetime? Conditional on release vs. continued supervision? Reports that don’t specify the time-frame and the conditions invite cross on every ambiguity, and the ambiguity often determines whether the testimony is meaningful at all.
Single-instrument anchoring
The literature increasingly favors triangulation across instrument types. A report that relies on a single actuarial score without SPJ formulation, or a single SPJ instrument without actuarial anchor, is a target for the “why didn’t you use…” line of cross.
PCL-R without certification
The Hare PCL-R is widely used in violence risk and SVP contexts. Hare’s training and certification standards are explicit, and the literature is clear that lack of formal training affects reliability. Reports that use the PCL-R without documented certification or substantive training are challenged on that ground alone, often successfully.
Protective factors ignored
Modern SPJ frameworks (e.g., the SAPROF) require explicit consideration of protective factors that modulate risk. Reports that catalog risk factors without protective-factor analysis present a one-sided picture, and the pattern is increasingly cited in published exclusions and in adverse appellate reasoning.
Risk “level” conflation
“High risk” on the VRAG-R is not the same as “high risk” on the HCR-20 is not the same as “high risk” on the Static-99R. Each tool has its own categorization scheme tied to its own norming sample. Reports that use the qualitative label without the underlying scoring and comparison-group reference confuse the record and invite reliable impeachment.
Confounds unaddressed
Mental illness, substance use, situational triggers, supervision conditions, and treatment response all interact with the static risk factors that drive actuarial scores. Reports that produce an actuarial score and stop — without the formulation step that addresses how these confounds modify the interpretation — leave the most defensible portion of the analysis unwritten.
Ultimate-issue overreach
Federal Rule of Evidence 704(b) prohibits expert opinion on the ultimate mens-rea question in federal criminal cases, and many states have analogs. In civil commitment and SVP proceedings, the law often requires a finding of “likelihood” of future dangerousness; the evaluator’s appropriate role is to characterize the risk, not to make the legal finding. Reports that opine directly on the ultimate question are challengeable on the procedural posture before substance is reached.
Each tool answers a slightly different question.
The forensic violence-risk toolbox is large and the choices matter. The VRAG-R is appropriate for adult male offender populations and produces a long-term recidivism estimate. The HCR-20 V3 is a general-population SPJ instrument with strong support for criminal and civil contexts. The COVR was developed for civil psychiatric inpatients and produces a short-term post-discharge estimate. The Static-99R and SVR-20 are sexual-violence specific. The SAPROF and SAPROF- SO add protective-factor analysis. The PCL-R is not a risk tool per se but is a strong predictor that informs risk judgment, and is required by some jurisdictional SVP statutes.
The choice of instrument is itself a Daubert question. Reports that don’t justify the choice — why this tool, for this population, for this question, in this jurisdiction — leave the foundational inquiry exposed. The answer should be in the report, not waiting to be elicited on the stand.

Violence risk testimony in a capital sentencing proceeding sits on top of Barefoot, Ake, and Estelle v. Smith, 451 U.S. 454 (1981), with jurisdiction-specific procedural requirements layered on top. Civil commitment proceedings vary by state on burden, standard of proof, and the role of expert testimony. SVP proceedings sit on top of Hendricks and Crane plus state-specific statutes. Parole and probation contexts have their own procedural and substantive frameworks.
